General Conditions

You are prohibited from using our products for any unlawful or unauthorized purposes that breach the laws of your region. The reproduction, copying, or resale of our products, along with our marketing materials, content, images, videos, or packaging, is strictly forbidden. We reserve the right to cancel orders at our discretion, which could arise from limited stock, logistical constraints in your area, or payment issues flagged by our payment providers. You are responsible for providing accurate, complete, and up-to-date account and purchase information for any transactions made in our store.

Distribution & Retail Policy

At Whipped, we are committed to maintaining the integrity of our brand, ensuring consistent quality, and delivering an authentic customer experience. To achieve this, we follow a strictly controlled distribution model.

Unauthorised Resale Prohibited: Products purchased from Whipped, whether online or offline, are intended for personal use only. Any individual or entity found reselling our products without prior written authorization from us will be in violation of this policy.

Authorised Sales Channels Only: Whipped products are sold exclusively through our official website and select authorised retail partners. These partners have been carefully chosen and trained to represent our brand values, ensure product authenticity, and provide a premium customer experience.

No Third-Party Resale Rights: Customers, distributors, or retailers who have not been formally appointed by Whipped are strictly prohibited from selling, listing, or distributing our products via online marketplaces (such as Amazon, Flipkart, etc.), retail outlets, or any other sales platform.

We reserve the right to take legal action against any unauthorised resale or misuse of our brand, including but not limited to restricting future purchases, cancellation of existing orders, and pursuing claims for damages.

Product Description & Material Disclosure Policy

At Whipped, we take pride in showcasing and promoting garments that celebrate India’s rich heritage of hand-spun, handwoven, and naturally dyed textiles. All product descriptions on our website are provided in good faith and are based on information shared by our sourcing partners and vendors.

While we make every reasonable effort to verify the authenticity of the materials and processes described, Whipped does not manufacture these fabrics in-house and relies on third-party suppliers for procurement. As such, we cannot independently guarantee the accuracy of claims related to hand-spinning, handweaving, or natural dyeing.

Limitation of Liability: In the event that any information regarding the textile origin, method of production, or dyeing process is later found to be inaccurate or misleading, Whipped shall not be held liable for any damages, claims, or losses arising therefrom. Customers acknowledge this limitation upon making a purchase.

We remain committed to transparency and will always strive to work with vendors who align with our values of craftsmanship, authenticity, and sustainability.

Brand Usage & Trademark Policy

Whipped is a registered brand owned and operated by Digital Fine Fast Brands Private Limited. All brand names, logos, product designs, and associated visual elements are the intellectual property of the company and are protected under applicable trademark and copyright laws.

Unauthorised Use Prohibited:

No individual, business, or third party is permitted to use the Whipped name, logo, likeness, or brand identity for the purpose of manufacturing, marketing, or selling any products—including but not limited to toys, accessories, hangers, apparel, or merchandise—without prior written approval from the company.

Trademark Protection – "Kimono Shirts" (Class 35):

We hold an active trademark for the term “Kimono Shirts” under Class 35, covering retail and marketing services. Any unauthorised use of this term in commercial or promotional contexts, including online listings, advertisements, or retail materials, is a violation of our trademark rights and will be subject to legal enforcement. Any unauthorised merchandising, imitation, or misuse of the Whipped brand or its trademarks will be considered infringement and may lead to legal action.

Pricing

We take great care in setting our product prices and rarely adjust them. However, we reserve the right to revise pricing or discontinue products at any time. Updated prices will be clearly shown on the website, and discontinued items may be removed from view.

Order Acceptance & Cancellation Policy

While we strive to fulfill every order placed on our website, Whipped reserves the right to accept or decline any order at our sole discretion, without providing a specific reason.

In certain cases, we may choose not to process or fulfill an order due to unforeseen circumstances, stock availability, pricing errors, suspected fraud, or internal policy decisions. If an order is cancelled by us after payment has been made, the customer will be notified and a full refund will be issued.

This policy helps us maintain the integrity, quality, and operational efficiency of our brand.

Delivery and Shipping

We provide shipping to most locations across India. A nominal fee may apply for the service for rejected COD orders, which may also result in restrictions on future purchases. Where applicable, you will receive an email confirmation for your order, along with tracking details available on our website. Please note that delivery times can be influenced by external factors and are not guaranteed.

Re-shipment Policy for Undelivered Orders (RTO & Failed Deliveries)

At Whipped, we make every effort to ensure smooth and timely delivery of all orders. However, in cases where an order is returned to origin (RTO) due to an unsuccessful delivery attempt—such as customer unavailability, refusal to accept, or incorrect address—we offer the option to re-ship the order under the following terms:

  1. Cash on Delivery (COD) Orders:
    If a COD order is returned due to a failed delivery attempt, we can re-ship the order upon request. However, the customer must convert the order to prepaid and pay the full order value in advance. Only after receiving the payment will a second delivery attempt be made.
  2. Prepaid Orders:
    If a prepaid order is returned undelivered, we can re-ship the order upon request. However, in such cases, an additional delivery fee will apply for the second shipment. This charge must be paid by the customer before re-dispatch.

We are not liable for any refunds if an order is lost or delivered to an incorrect address due to inaccurate information provided by the customer. Additionally, we are not obligated to provide proof of misdelivery in such cases.

These steps help us ensure accountability in delivery and reduce the operational costs associated with failed shipments.

Warranty, Cancellations, Refunds & Returns

Each of our limited and exclusive pieces is handcrafted on order, which means we do not accept returns or cancellations. However, we do offer a one-time free size exchange for orders within India. This size exchange policy does not apply to international orders. For any size or product-related questions, our customer care team is always happy to assist you.

Indemnification
